Terms of Service

These Terms of Service govern the use of Tucker Digital Media’s websites, services, forms, booking pages, and service offerings, including Local Lead Machine.

By using our website, submitting a form, booking a call, purchasing services, or working with Tucker Digital Media, you agree to these Terms.

1. Company Information

Tucker Digital Media provides digital marketing, website, lead-capture, follow-up, and business-support services for local businesses.

Our TDM Managed Roofing Website package provides a practical website and estimate-request process for roofing companies. Additional automation services require separate written scope.

2. Services

Tucker Digital Media may provide services including, but not limited to:

- Website or landing page setup

- Lead-capture forms

- Quote request forms

- Call-to-action improvements

- Missed-call follow-up setup

- Email or text follow-up workflows

- Review request workflows

- CRM or pipeline setup

- Monthly reporting

- Website and lead-system optimization

- Consulting or support related to digital lead capture

Specific services, pricing, timelines, and deliverables are defined in the client’s proposal, invoice, service agreement, onboarding documents, or written communication with Tucker Digital Media.

3. TDM Managed Roofing Website

The TDM Managed Roofing Website package includes five pages—Home, Services, About, Service Area and Contact / Estimate—one estimate request form, mobile call links, one lead pipeline and email notifications to client-approved recipients. Setup includes one consolidated revision round. Monthly service includes managed hosting and connection maintenance, one form-delivery check and up to 30 minutes of minor text or photo edits. Unused editing time does not accumulate.

SMS, missed-call text-back, automated follow-up and review-request automation require separate written scope and verified setup. Paid advertising, traffic generation, rankings or lead/revenue guarantees, additional pages, custom applications and unlimited edits are outside this base package. Existing written client agreements continue to govern their own services.

4. No Guarantee of Results

Tucker Digital Media works to improve lead capture, follow-up systems, and online presentation. However, we do not guarantee specific business results, search rankings, lead volume, revenue, booked jobs, conversion rates, or review counts.

Results may vary based on many factors outside our control, including market demand, competition, response time, pricing, reputation, seasonality, advertising spend, customer reviews, and the client’s own sales process.

5. Client Responsibilities

Clients are responsible for providing accurate and timely information needed to complete services.

This may include:

- Business name and contact information

- Website/domain access or coordination

- Logo, photos, and brand assets

- Service descriptions

- Service areas

- Review links or review profiles

- Business phone number

- Offer details

- Approval of copy, designs, forms, and workflows

- Payment information

- Any required third-party account access

Clients are responsible for ensuring that all materials they provide, including logos, photos, text, testimonials, reviews, and business claims, are accurate and legally permitted for use.

Tucker Digital Media is not responsible for delays caused by missing information, delayed approvals, unavailable access, inaccurate materials, or third-party account issues.

6. Payments and Billing

Pricing is determined by the specific offer, invoice, agreement, or written proposal provided to the client.

The standard TDM Managed Roofing Website package is $799 for setup and $399 per month. The initial base payment is $1,198, including setup and the first month; the first month is not charged a second time. Any applicable tax and the final amount are disclosed before payment.

The first renewal is scheduled one calendar month after the initial payment, then monthly on the payment provider's supported anniversary schedule. The actual next-charge date and recurring-payment method are verified and disclosed in the client service order. Recurring payment requires the client's authorization. Sending an invoice or starting checkout does not establish successful payment.

Setup begins after the agreement is signed and the successful initial payment, complete onboarding information, required assets and authorized access are received. The target is 7–14 business days after these prerequisites are complete, with the actual window confirmed after review.

Payment may be processed through PayPal, credit/debit card, bank payment, or another approved payment processor.

Tucker Digital Media may pause or stop work if payment is late, declined, disputed, reversed, or not received.

7. Cancellation

Written cancellation notice received at tucker@tuckerdigitalmedia.com before the next scheduled renewal stops that renewal and subsequent recurring charges. Service continues through the paid period, then managed hosting and support end. Coordinate domain handoff before removing the website. Any migration or rebuild outside the agreed service requires separate scope. Existing written client agreements continue to govern their own cancellation terms.

8. Refunds

The setup fee becomes non-refundable once setup work begins. The first and subsequent monthly fees become non-refundable when their corresponding paid service periods begin, subject to any refund required by applicable law. Record any agreed client-specific exception in writing before the agreement is issued.

9. Revisions and Changes

The standard package includes one consolidated revision round within the agreed five-page scope, requested within 14 calendar days after the initial setup is presented. Monthly service includes up to 30 minutes of minor text or photo edits. Extra revisions, major redesigns, added pages or other expanded work require an approved quote before work begins.

10. Third-Party Tools and Platforms

Tucker Digital Media may use third-party tools and platforms to deliver services, including but not limited to website platforms, CRM tools, form builders, calendar tools, payment processors, email platforms, SMS providers, domain registrars, analytics tools, and automation platforms.

These third-party tools may have their own terms, fees, limitations, privacy policies, outages, or technical issues.

Tucker Digital Media is not responsible for outages, pricing changes, restrictions, account suspensions, delivery issues, or platform changes caused by third-party providers.

11. Email, SMS, and Follow-Up Workflows

Some services may involve email, SMS, missed-call text-back, review requests, or other follow-up workflows.

Clients are responsible for ensuring that their use of these workflows complies with applicable laws, rules, consent requirements, and industry guidelines.

Tucker Digital Media may provide setup and support, but the client is responsible for the accuracy of customer lists, consent status, message content approvals, and how the client communicates with their own customers.

Tucker Digital Media does not send spam on behalf of clients and may refuse to set up or send messages that appear misleading, unlawful, abusive, or non-compliant.

12. Reviews and Testimonials

Tucker Digital Media may help clients request reviews from real customers.

We do not create fake reviews, buy reviews, manipulate reviews, or encourage misleading review practices.

Clients are responsible for following the review policies of Google, Facebook, Yelp, BBB, and any other review platforms they use.

13. Intellectual Property

Unless otherwise agreed in writing, Tucker Digital Media retains ownership of its internal systems, workflows, templates, processes, strategies, code snippets, automation logic, documents, and proprietary materials.

Clients retain ownership of their own logos, business information, photos, customer materials, and content they provide.

Upon full payment, clients may use completed website content, landing pages, copy, and marketing materials created specifically for their business as part of the agreed service.

Tucker Digital Media may reuse general strategies, layouts, templates, workflows, and non-client-specific materials for other projects.

14. Website Content and Accuracy

Clients are responsible for reviewing and approving all website copy, service claims, pricing claims, warranty claims, licensing claims, insurance claims, testimonials, photos, and other business representations before publication.

Tucker Digital Media may assist with drafting and organizing content, but the client is responsible for ensuring that all published business information is accurate.

15. Account Access and Security

Clients may need to provide access to certain accounts or systems.

Clients should not send passwords through public forms or unsecured messages.

When needed, Tucker Digital Media may request secure access through approved methods.

Clients are responsible for maintaining control of their own accounts, including domain registrars, Google Business Profiles, payment processors, email accounts, hosting accounts, and advertising accounts.

16. Limitation of Liability

To the fullest extent permitted by law, Tucker Digital Media is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, lost leads, lost business opportunities, data loss, platform outages, or third-party service failures.

Tucker Digital Media’s total liability for any claim related to services is limited to the amount paid by the client to Tucker Digital Media for the specific service giving rise to the claim during the three months before the claim.

17. No Professional Legal, Tax, or Financial Advice

Tucker Digital Media does not provide legal, tax, financial, insurance, or accounting advice.

Clients should consult qualified professionals for legal, tax, financial, compliance, insurance, or licensing questions.

18. Acceptable Use

Clients may not use Tucker Digital Media services for unlawful, deceptive, abusive, harassing, infringing, fraudulent, or harmful purposes.

Tucker Digital Media may refuse, suspend, or terminate services if a client uses our services in a way that violates applicable laws, platform policies, or these Terms.

19. Termination

Tucker Digital Media may terminate or suspend services if a client fails to pay, violates these Terms, provides false information, abuses staff, requests unlawful work, or creates unreasonable operational risk.

Termination does not relieve the client of amounts already due.

20. Changes to These Terms

Tucker Digital Media may update these Terms from time to time.

The updated version will be posted on our website with a new effective date.

Continued use of our website or services after changes are posted means you accept the updated Terms.
